The Instruction regulates the ancillary obligation to provide information regarding transactions carried out with cryptoassets.

## Definitions:

* Cryptoasset: digital representation of value whose price may be expressed in local or foreign sovereign currency, traded electronically using cryptography and distributed ledger technologies, which may be used as a form of investment, a means of transferring value or accessing services, and which does not constitute legal tender; and
* Cryptoasset exchange: a legal entity, even if non-financial, that offers services related to transactions carried out with cryptoassets, including intermediation, trading or custody, and that may accept any means of payment, including other cryptoassets.

{% hint style="warning" %}
For the Federal Revenue Service, any legal entity that enables the intermediation, trading or custody of cryptoassets must be considered an exchange.
{% endhint %}

## Obligations:

Any cryptoasset exchange must provide information on any transactions carried out, including with respect to its users.

In the case of individuals or legal entities that are not considered cryptoasset exchanges, they will only need to provide information when the monthly value of transactions carried out with cryptoassets exceeds R$ 30,000.00 (thirty thousand reais), even if the transactions occur in a peer-to-peer (P2P) manner.

The Instruction sets out various information that must be reported, such as the date of the transactions, the holders, the cryptoassets used, among others.

The information must be provided monthly, and, in the case of exchanges, they will only need to provide information about their users on December 31 of each year.

## Penalties:

The individual or legal entity that fails to provide the information it is required to provide, or provides it after the deadlines set, or omits information or provides inaccurate, incomplete or incorrect information, shall be subject to the following fines:

I - for late submission:

a) R$ 100.00 (one hundred reais) per month or fraction of a month, if an individual;

b) R$ 500.00 (five hundred reais) per month or fraction of a month, if a legal entity in start-up phase, immune or exempt, opting for Simples Nacional, or that in the last return determined Corporate Income Tax (IRPJ) on the basis of presumed profit; or

c) R$ 1,500.00 (one thousand five hundred reais) per month or fraction of a month, if the declarant is a legal entity not included in the items above.

II - for submission with inaccurate, incomplete or incorrect information or with omission of information:

a) 1.5% (one and five tenths percent) of the value of the transaction to which the omitted, inaccurate, incorrect or incomplete information refers, if the declarant is an individual; or

b) 3% (three percent) of the value of the transaction to which the omitted, inaccurate, incorrect or incomplete information refers, not less than R$ 100.00 (one hundred reais), if the declarant is a legal entity.

III - for failure to comply with a summons to fulfill an ancillary obligation or to provide clarifications within the deadline, the amount of R$ 500.00 (five hundred reais) per calendar month.
