# 1. Federal Constitution

Art. 5. All persons are equal before the law, without distinction of any kind, guaranteeing to Brazilians and foreigners residing in the Country the <mark style="background-color:orange;">inviolability of the rights to life, liberty, equality, security and property</mark>, as follows:

II - no one shall be obliged to do or refrain from doing something <mark style="background-color:orange;">except by virtue of law;</mark>

IV - freedom of expression of thought is free, <mark style="background-color:orange;">anonymity being prohibited;</mark>

VI - <mark style="background-color:orange;">freedom of conscience and belief is inviolable</mark>, and the free exercise of religious worship is guaranteed, with protection, in accordance with the law, for places of worship and their liturgies;

VIII - <mark style="background-color:orange;">no one shall be deprived of rights on account of religious belief or philosophical or political conviction</mark>, unless they invoke them to exempt themselves from a legal obligation imposed on all and refuse to comply with an alternative obligation, established by law;

IX - the expression of intellectual, artistic, scientific and communication activity is free, <mark style="background-color:orange;">regardless of censorship or license;</mark>

X - <mark style="background-color:orange;">the intimacy, private life, honor and image of persons are inviolable</mark>, with the right to compensation for material or moral damage resulting from their violation being ensured;

XII - the secrecy of correspondence and telegraphic communications is inviolable, <mark style="background-color:orange;">of data</mark> and telephone communications, except, in the latter case, by court order, in the cases and in the manner established by law for purposes of criminal investigation or criminal procedural instruction;

XVII - <mark style="background-color:orange;">freedom of association for lawful purposes is fully guaranteed</mark>, with paramilitary ones being prohibited;

XVIII - the creation of associations and, in accordance with the law, of cooperatives <mark style="background-color:orange;">do not depend on authorization, and state interference in their operation is prohibited;</mark>

XXIX - associations may only be compulsorily dissolved or have their activities suspended <mark style="background-color:orange;">by court decision</mark>, with a final and nonappealable judgment required in the first case;

XXII - the <mark style="background-color:orange;">right to property;</mark>

XXVII - authors have the <mark style="background-color:orange;">exclusive right to use, publish or reproduce their works</mark>, transferable to heirs for the period established by law;

XXX - the <mark style="background-color:orange;">right of inheritance;</mark>

XXXIX - <mark style="background-color:orange;">there is no crime without a prior law defining it</mark>, nor punishment without prior legal provision;

XL - <mark style="background-color:orange;">the penal law shall not retroact</mark>, except to benefit the defendant;

LIV - no one shall be deprived of liberty or property without the <mark style="background-color:orange;">due process of law;</mark>

LV - litigants, in judicial or administrative proceedings, and accused persons in general <mark style="background-color:orange;">are guaranteed adversarial proceedings and full defense</mark>, with the means and resources inherent to it;

LVI - inadmissible in proceedings are the <mark style="background-color:orange;">evidence obtained by unlawful means;</mark>

LXVII - <mark style="background-color:orange;">there shall be no civil imprisonment for debt</mark>, except that of the person responsible for the voluntary and inexcusable nonperformance of a support obligation ~~and that of the unfaithful depository~~;

LXXIX - there is guaranteed, in accordance with the law, the <mark style="background-color:orange;">right to the protection of personal data</mark>, including in digital media.

It is the responsibility of the Union to issue currency, manage the country's foreign exchange reserves and supervise financial operations, especially those involving credit, exchange and capitalization, as well as insurance and private pension plans.
